The Protection of innovations and inventions in India is governed by "The Patents Act 1970 (as amended)".

Patent is the exclusive right to use or exercise an invention granted to a person for a limited period i.e., for 20 years in consideration of the disclosure of such invention. Patent protection means that the invention cannot be commercially made, used, distributed or sold without the patent owner's consent.

A patent confers an exclusive right to use the invention and the right to manufacture and market it. It further gives the patentee the statutory right to sue infringers. The patent owner may give permission to, or license to other party to use the invention on mutually agreed terms. The owner may also sell his right in the invention to someone else, who will then become the new owner of the patent.
