The Protection of Trade Marks in India is governed by "The Trade Marks Act, 1999"
A trade mark is a distinctive sign capable of being represented graphically and which identifies certain goods or services as those produced or provided by a specific person or enterprise. Marks in a trade includes logo, brand, heading, label, ticket, name, signature, word, letter, numeral, shape of goods, packaging or combination of colours or any combination thereof.
After registration of a trade mark, the proprietor gets the exclusive right to use the mark in relation to the goods/services for which it is registered and also gets the statutory right to take legal action against others who infringes such trademark.
