Overview
In India, plant variety protection is governed by the Protection of Plant Varieties and Farmers' Rights (PPV&FR) Act, 2001. The Act provides legal protection to breeders of new plant varieties while recognizing and safeguarding the rights of farmers.
Registration of a plant variety grants the breeder exclusive rights to produce, sell, market, distribute, import, and export the registered variety. The term of protection is generally 18 years for trees and vines, and 15 years for other crops and notified extant varieties, as prescribed under the Act.
